The Seccua GmbH device warranty
Limited warranty for one (1) year
ONLY FOR PRODUCTS OF SECCUA GMBH
CONSUMER RIGHTS AND LIMITATIONS. CONSUMERS WHO ARE SUBJECT TO THE PROTECTION OF THE CONSUMER PROTECTION LAWS OF THE COUNTRY IN WHICH THE PRODUCT WAS PURCHASED OR THE COUNTRY OF THEIR RESIDENCE AT THE TIME OF PURCHASE SHALL BE ENTITLED TO THE BENEFITS ACCRUING TO THEM UNDER THIS PLAN IN ADDITION TO ANY RIGHTS ARISING UNDER SUCH CONSUMER PROTECTION LAWS. THIS WARRANTY DOES NOT EXCLUDE OR LIMIT ANY CONSUMER RIGHTS ARISING FROM DEFECTS IN THE PURCHASED GOODS. HOWEVER, AS DESCRIBED BELOW, TO THE EXTENT PERMITTED BY LAW, SECCUA GMBH EXCLUDES ALL WARRANTIES, STATUTORY OR IMPLIED. TO THE EXTENT WARRANTIES OF THIS NATURE CANNOT BE LAWFULLY DISCLAIMED, ALL WARRANTIES OF THIS NATURE, TO THE EXTENT PERMITTED BY LAW, ARE LIMITED IN DURATION TO THE DURATION OF THE EXPRESS WARRANTY DESCRIBED BELOW AND TO SUCH REPAIR OR REPLACEMENT SERVICES AS SECCUA DETERMINES IN ITS SOLE DISCRETION. SOME STATES (COUNTRIES OR TERRITORIES) DO NOT ALLOW THE LIMITATION OF TIME OF THE IMPLIED WARRANTY OR CONDITION, SO THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU IN FULL. THESE TERMS AND CONDITIONS GRANT YOU SPECIFIC LEGAL RIGHTS, AND YOU MAY ALSO HAVE OTHER RIGHTS UNDER MANDATORY LAWS OF THE RELEVANT STATE (OR COUNTRY OR TERRITORY) FOR THE FOREGOING REASONS. THESE PROVISIONS SHALL BE GOVERNED BY THE LAWS OF THE COUNTRY IN WHICH THE PRODUCT WAS PURCHASED. “SECCUA”, THE WARRANTOR OF THESE TERMS, IS IDENTIFIED IN THE APPENDIX DEPENDING ON THE COUNTRY IN WHICH THE PRODUCT WAS PURCHASED.
Seccua GmbH’s warranty obligations for this Seccua GmbH hardware product are limited as set forth herein:
The warrantor as set forth in the table below (“Seccua GmbH”) warrants this hardware product to be free from defects in materials and workmanship for a period of one (1) year from the date of original purchase (“Warranty Period”).
If a defect occurs and Seccua GmbH is effectively notified of it within the Warranty Period, Seccua GmbH will, at Seccua GmbH’s discretion, (1) repair the Product free of charge with new or refurbished parts that are as good as new in terms of their performance and reliability, (2) replace the Product with a product that is either new or refurbished and that is as good as new in terms of its performance and reliability and that is at least equivalent in function to the original Product, or (3) refund the purchase price of the Product.
Seccua GmbH reserves the right, in fulfillment of warranty obligations, to provide you with newly manufactured or refurbished, operable, used replacement parts, also for self-assembly. Seccua GmbH warrants that products and parts replaced under warranty will be free from defects in materials and workmanship for ninety (90) days from the date of replacement or repair, but for no less than the remainder of the original warranty period. When a product or part is replaced, the new item becomes its property, while the replaced item becomes the property of Seccua GmbH. Parts provided in fulfillment of warranty obligations must be installed in the product for which warranty was claimed. If you receive a refund, your product becomes the property of Seccua GmbH.
EXCLUSIONS AND LIMITATIONS. TO THE FULLEST EXTENT PERMITTED BY LAW, THE FOREGOING WARRANTIES, REMEDIES AND CONDITIONS APPLY EXCLUSIVELY AND ARE IN LIEU OF ALL OTHER WARRANTIES, REMEDIES AND CONDITIONS, WHETHER ORAL OR WRITTEN, BY OPERATION OF LAW, EXPRESS OR IMPLIED. TO THE EXTENT PERMITTED BY LAW, Seccua GmbH EXPRESSLY DISCLAIMS ALL WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, INCLUDING ALL WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. IF Seccua GmbH CANNOT LEGALLY EXCLUDE WARRANTIES OF ANY KIND, ALL WARRANTIES OF THIS KIND ARE LIMITED IN DURATION TO THE DURATION OF THE EXPRESS WARRANTY AND TO THE REPAIR OR REPLACEMENT SERVICES THAT Seccua GmbH DETERMINES AT ITS OWN DISCRETION. SOME STATES (COUNTRIES OR TERRITORIES) DO NOT ALLOW THE LIMITATION OF TIME OF THE IMPLIED WARRANTY OR CONDITION, SO THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU IN FULL.
Seccua GmbH dealers, agents and employees are not authorized to modify, extend or amend this warranty. If any provision hereof shall be unlawful or unenforceable, it shall in no way affect or impair the validity, lawfulness or enforceability of the remaining provisions hereof.
This Limited Warranty applies only to hardware products manufactured by or for Seccua GmbH and identified by the “Seccua” trademark, trade name or logo affixed thereto (“Seccua Products”). This Limited Warranty does not apply to hardware products that are not Seccua Products or to software, even if packaged or sold with a Seccua GmbH Product. Other manufacturers, suppliers or publishers may provide a separate warranty for their own products packaged with Seccua hardware products. Software sold by Seccua GmbH under the Seccua brand is also not covered by this limited warranty. Please refer to the Seccua Software License Agreement for more information about your rights in this regard. Seccua GmbH does not warrant that the operation of the product will be uninterrupted or error free. Seccua GmbH is not responsible for any disadvantages caused by not following instructions regarding the use of the product.
The warranty does not apply: (a) to consumable parts such as filters, unless there is a defect in material and workmanship, (b) to mere deterioration in appearance such as. scratches, dents or broken plastic parts on connectors, which does not affect the function of the product and does not have a material adverse effect on its use, (c) for damage related to the use of products that are not Seccua products, (d) for damage caused by accident, misuse, abuse, misapplication, contact with liquids, fire, earthquake or other external effects, (e) for damage caused by uses outside the specified uses or parameters, (f) for damage caused by services not provided by Seccua GmbH or a Seccua GmbH Authorized Service Partner (SASP), (g) for products and parts that have been modified without the written permission of Seccua GmbH, (h) for defects resulting from normal wear and tear or other normal signs of aging, or (i) if the serial number affixed by Seccua GmbH has been removed or defaced.
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL SECCUA GMBH BE LIABLE FOR ANY DIRECT, SPECIAL, INDIRECT OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR IN CONNECTION WITH THE BREACH OF WARRANTY OR ANY CONDITION OR ANY OTHER CAUSE OF ACTION, INCLUDING, WITHOUT LIMITATION, LIABILITY FOR LOSS OF USE OR REVENUE, LOSS OF ACTUAL OR ANTICIPATED PROFITS (INCLUDING PROFITS FROM CONTRACTS), FOR LOSS OF USE OF MONEY, FOR LOSS OF ANTICIPATED SAVINGS, FOR LOSS OF BUSINESS, FOR LOSS OF OPPORTUNITY, FOR LOSS OF GOODWILL, FOR DAMAGE TO REPUTATION, FOR LOSS, IMPAIRMENT OR DAMAGE TO DATA, NOR FOR ANY OTHER INDIRECT OR CONSEQUENTIAL DAMAGES HOWEVER CAUSED, INCLUDING THE REPLACEMENT OF EQUIPMENT AND ASSETS. THE FOREGOING LIMITATION DOES NOT APPLY TO CLAIMS BASED ON DEATH OR PERSONAL INJURY AND DOES NOT APPLY TO LEGAL LIABILITY FOR INTENTIONAL OR GROSSLY NEGLIGENT ACTS OR OMISSIONS. SECCUA EXPRESSLY DOES NOT REPRESENT THAT SECCUA WILL BE ABLE TO REPAIR ANY PRODUCT OR HAVE ANY PRODUCT REPLACED UNDER THIS WARRANTY WITHOUT JEOPARDIZING OR LOSING PROGRAMS OR DATA. THE LAWS OF SOME STATES (COUNTRIES OR TERRITORIES) DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THESE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY IN YOUR CASE.
MAKING USE OF THE WARRANTY
Please review the online help resources available on our website at https://support.seccua.com/hc/en-us before making any warranty claims. If the product still does not function properly after using these resources, please contact a Seccua GmbH representative or a Seccua GmbH owned sales office (“Sales Office”) or a SASP. Appropriate contact information can be found at the bottom of this document. If you contact us by telephone, telecommunication charges will apply depending on your location. Your call will be answered by a member of the technical support team or a SASP. This person will advise you and decide if and which services are required for your product. You must assist Seccua GmbH in diagnosing the fault and follow the procedures specified by Seccua GmbH for claiming warranty.
Seccua GmbH will provide service under the warranty either (i) upon delivery to a Seccua store, or a SASP, where warranty service will either be provided on-site or the product will be returned to a Seccua GmbH, or (ii) by sending paid return shipping receipts (and, to the extent you no longer have the original packaging, packing materials) that allow you to return the product to Seccua GmbH or (iii) by sending newly manufactured, or refurbished, serviceable, used replacement parts for self-assembly (“do-it-yourself service”). Upon delivery of the replacement product or part, title to the original product or part shall pass to Seccua GmbH; you agree to comply with the relevant instructions of Seccua GmbH, in particular to immediately arrange for the return of the original product or part therefor. To the extent Seccua GmbH provides a “do-it-yourself service” that requires the return of the product or part to be replaced, Seccua GmbH may require a credit card authorization as security for the retail price of the replacement part and shipping charges. If you comply with Seccua GmbH’s instructions, Seccua GmbH will cancel the credit card authorization so that you will not be charged for the cost of the replacement part and shipping. If you do not return the replaced component as instructed, or if warranty service is not provided for the replaced product or part, Seccua GmbH will charge your credit card for the authorized amount.
Service options, component availability and response times may vary from country to country. Seccua GmbH reserves the right to change service options at any time. To the extent that the product is located in a country where service is not available and cannot be repaired there, it is your responsibility (subject to any mandatory legal requirements to the contrary) to arrange for shipment at your own cost and risk. To the extent that you wish to receive services outside the country in which the product was purchased, you are responsible for compliance with all import and export regulations and must pay all applicable customs duties, taxes and fees. For international services, Seccua GmbH reserves the right to replace defective products with such products or repair them with such parts that are equivalent but meet local standards. To the extent permitted by law, Seccua GmbH may make services under the warranty conditional upon you providing proof of purchase details and/or registering separately.
